DAPTAP TERMS OF SERVICE

Welcome to Daptap. These Terms of Service (“Terms”) govern your access to and use of the Daptap website, mobile experiences, NFC devices, link-in-bio tools, analytics, AI-powered features, and all associated products and services (collectively, the “Services”) provided by DaptapCo (“Daptap”, “we”, “our”, or “us”).

By creating an account, activating a Daptap device, or using any of the Services, you agree to these Terms. If you do not agree, you may not use Daptap.

1. Who Can Use Daptap

You may use the Services only if:

1. You are at least 13 years old, or older if required by local law;
2. You can legally form a binding contract;
3. You agree to comply with these Terms and all applicable laws.

If you create an account on behalf of a business or organization, you represent that you are authorized to bind that entity.

2. Your Daptap Account

You are responsible for:

1. Maintaining accurate account information;
2. Keeping your password safe;
3. All activity that occurs under your account.

We reserve the right to disable or suspend accounts that violate our Terms, present a security or fraud risk, or misuse the platform.

3. Your Content

“Content” includes links, text, images, media, files, profile information, names, usernames, and anything you upload or display on your Daptap page.

You retain ownership of your content.

However, by using Daptap, you grant us a worldwide, non-exclusive license to host, store, reproduce, publicly display, modify (for formatting only), distribute, and use your content to operate and improve the Services.

You agree that your content must not:

1. Violate laws or regulations;
2. Be deceptive, harmful, hateful, or fraudulent;
3. Infringe any third-party rights;
4. Include malware, unauthorized ads, or scraping scripts;
5. Promote illegal activities.

We may remove content or restrict accounts that violate these rules.

4. Prohibited Uses

You agree not to:

1. Use Daptap for unlawful, fraudulent, or harmful purposes;
2. Interfere with the platform or its infrastructure;
3. Attempt unauthorized access to accounts or systems;
4. Reverse-engineer or replicate our software or databases;
5. Scrape, harvest, or collect data without permission;
6. Use bots or automation to abuse Services;
7. Link to deceptive, explicit, or harmful content.

We may take action—including terminating your account—if we detect misuse.

5. Daptap NFC Devices & Hardware

Daptap offers NFC-enabled cards, stickers, and accessories. By using Daptap hardware, you agree that:

1. Devices must not be used for stalking, harassment, or unauthorized tracking;
2. You will not tamper with or attempt to clone devices;
3. You are responsible for the content your device links to;
4. Device scans may be logged for analytics and security;
5. Counterfeit or unauthorized replicas may be disabled.

We may deactivate devices that violate these Terms.

6. AI & Automation Tools

Daptap provides optional AI-powered features including:

1. Smart link suggestions
2. Caption generators
3. Marketing automation
4. Pixel attribution
5. Analytics recommendations
6. Auto-posting and scheduling

You acknowledge that:

1. AI outputs may be imperfect or inaccurate;
2. You must review all AI-generated content before publishing;
3. You are responsible for how you use AI results.

We are not liable for any actions taken using AI outputs.

7. Payments, Subscriptions & Billing

7.1 Subscription Plans

Some features require a paid plan. Prices, tiers, and features may change.

7.2 Automatic Renewal

Subscriptions renew automatically unless canceled before the renewal date.

7.3 Payment Information

All payments are processed by secure third-party providers.

By subscribing, you authorize recurring charges.

7.4 Failed Payment

If payment fails, your access to paid features may be limited until resolved.

8. Refunds

Refunds follow the Daptap Refund Policy.

Generally, digital services and subscriptions are non-refundable unless required by law.

9. Third-Party Integrations

Daptap integrates with third-party services such as:

1. TikTok
2. Instagram / Meta
3. YouTube
4. Spotify & Apple Music
5. Analytics tools
6. Payment processors

Your use of third-party platforms is governed by their terms.

We are not responsible for actions or policies of third-party providers.

10. Intellectual Property

Daptap owns all rights, title, and interest in:

1. Software, code, infrastructure
2. Design, branding, trademarks, and logos
3. Marketing tools, devices, and analytics systems
4. AI models and proprietary features
5. Documentation and training materials

You agree not to copy, reproduce, or create derivative works without permission.

11. Service Changes

We may update, improve, or discontinue parts of the Services at any time.

This may include:

1. Adding new features
2. Removing legacy features
3. Updating pricing
4. Releasing new device models

We are not obligated to maintain backward compatibility.

12. Termination

We may suspend or terminate your account if you:

1. Violate these Terms;
2. Misuse Daptap or create security risks;
3. Fail to pay for subscription services;
4. Engage in fraudulent or unlawful behavior.

You may delete your account anytime through Settings.

Upon termination, you lose access to the Services and your content may be deleted.

13. Disclaimers

Daptap is provided “as is” and “as available.”

We do not guarantee:

1. Continuous, uninterrupted access;
2. 100% accuracy of analytics or AI outputs;
3. That content, links, or integrations will always work;
4. That device scans will be accurate;
5. That your data will never be compromised.

To the fullest extent permitted by law, we disclaim all warranties.

14. Limitation of Liability

To the maximum extent allowed by law, Daptap is not liable for:

1. Lost revenue, profits, customers, or data
2. Business interruption
3. Damages from device misuse or malfunction
4. Errors, bugs, or downtime
5. Third-party actions or integrations
6. AI-generated outputs
7. Unauthorized account access

Our total liability is limited to the amount you paid in the previous 12 months.

15. Indemnification

You agree to indemnify and hold Daptap harmless from any claims arising from:

1. Your content;
2. Your use of the Services;
3. Any breach of these Terms;
4. Your use of AI or automated tools;
5. Legal disputes involving your business or audience.

16. Governing Law

These Terms are governed by the laws of the State of California, unless prohibited by local law.

17. Changes to These Terms

We may update the Terms periodically.

The “Last Updated” date will reflect any revision.

Your continued use of Daptap after changes are published constitutes acceptance.
